1. Agreement to Terms

By accessing and using CarMate ("the Service"), you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not use our Service.

2. Description of Service

CarMate provides automated analysis of used car listings to help users make informed purchasing decisions. Our service includes:

• Automated analysis of car listings submitted via URL, screenshot upload, or manual entry
• Official DVLA and DVSA MOT history data verification
• Vehicle History Check (provenance), reporting outstanding finance, insurance write-off, stolen, scrapped, import/export, plate and keeper records sourced from Experian via One Auto API
• Deal scores, scam risk assessments, and pricing analysis
• PDF report generation for download and offline use
• Chat-based assistance for specific listings (up to 15 questions per report)
• Permanent storage and access to your previous reports

CarMate's analysis is provided for informational purposes only and does not constitute professional automotive, financial, or legal advice. Always conduct your own due diligence and consider an independent inspection before purchasing any vehicle.

3. User Accounts

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorised access or security breach

4. Report Credits & Purchases

CarMate operates on a report credit system:

• Report credits can be purchased in various packages
• Purchased report credits never expire
• One report credit is consumed per car listing checked
• Report credits are non-transferable and non-refundable except as described in Section 7
• All prices are displayed in GBP and include applicable taxes

5. Chat Questions

Each report includes chat questions about the specific car listing. Chat questions:

• Are specific to each individual report
• Cannot be transferred between different reports
• Expire when you navigate away from the report
• Are intended for clarification and additional information only

6. Acceptable Use

You agree NOT to:

• Use the Service for any illegal or unauthorised purpose
• Attempt to bypass, disable, or interfere with security features
• Use automated systems (bots, scrapers) to access the Service
• Reverse engineer, decompile, or extract source code
• Resell, redistribute, or commercially exploit the Service without authorization
• Submit false, misleading, or fraudulent information
• Abuse, harass, or harm others through the Service

7. Refunds & Cancellations

30-Day Money-Back Guarantee: If you are not satisfied with your report for any reason, contact us within 30 days of purchase at support@car-mate.co.uk and we will issue a full refund. No questions asked.

We also offer refunds under the following circumstances:

• Technical failures that prevent report generation will result in a full credit or cash refund
• Duplicate charges will be refunded in full
• Refund requests must be submitted within 30 days of purchase
• Refunds are processed to the original payment method within 5-10 business days

Please note: Disagreement with the analysis, assessment, or opinion does not in itself qualify for a refund. Our guarantee covers dissatisfaction with the service, not situations where the report was delivered correctly but the conclusions differ from your own view.

8. Disclaimers & Limitations

IMPORTANT: CarMate provides informational analysis only. We do not:

• Guarantee the accuracy, completeness, or reliability of any analysis
• Conduct physical inspections of vehicles
• Verify information provided in listings
• Provide professional mechanical or legal advice
• Guarantee the condition, value, or safety of any vehicle

Vehicle History Check data and data guarantee: Provenance results (finance, write-off, stolen, scrapped, import and similar markers) are provided by Experian and reflect the records held at the time of your check. We do not create, control or independently verify this data, and to the maximum extent permitted by law we exclude all liability for any error, omission, inaccuracy or delay in the data supplied by Experian. A clear result means no matching record was found at that moment; it is not a guarantee that the vehicle has no finance, has never been written off, or is not stolen, as records can be added or updated later. Where a History Check shows a data guarantee figure, that guarantee is provided and underwritten by Experian and is governed solely by Experian's data guarantee terms and conditions; it is not a guarantee given by CarMate or Moose Technologies Ltd, and any claim under it is subject to and limited by Experian's terms. For purchases of significant value, treat the History Check as one input alongside a physical inspection and your own due diligence.

Our analysis is based solely on information provided in the listing and the third-party records described above. You should:

• Conduct your own independent research and verification
• Inspect vehicles in person before purchase
• Obtain professional mechanical inspections for significant purchases
• Request vehicle history reports from official sources

9. Limitation of Liability

To the maximum extent permitted by law, CarMate and its operators shall not be liable for:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Damages arising from vehicle purchase decisions based on our analysis
• Inaccuracies in third-party listing information
• Service interruptions, errors, or technical issues

Our total liability for any claim shall not exceed the amount you paid for the specific report in question.

10. Privacy & Data

Your use of the Service is governed by our Privacy Policy, which describes:

• What data we collect and how we use it
• How we protect your information
• Your rights regarding your data
• Our compliance with UK GDPR regulations

11. Intellectual Property

All content, features, and functionality of CarMate are owned by us and protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute our software or content
• Use our branding, logos, or trademarks without permission
• Create derivative works based on the Service

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Continued use of the Service after changes constitutes acceptance of the revised Terms. We will notify users of significant changes via email or prominent notice on the Service.

13. Termination

We may suspend or terminate your access to the Service at any time for:

• Violation of these Terms
• Fraudulent or illegal activity
• Abusive behavior toward our staff or other users
• Any reason at our sole discretion

Upon termination, your right to use the Service will immediately cease. Unused report credits may be forfeited unless termination was without cause.

14. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be resolved in the courts of England and Wales.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CarMate regarding the use of the Service, superseding any prior agreements.
